Minor Mineral Rules

The relevant rules that apply under the MMDR Act are the Mining Concessions Rules 1960 and the Mineral Conservation and Development Rules, 1988. The health and safety of workers is governed by the Mining Regulations, 1955, established under the Mining Act, 1952. The Mines and Minerals Act, 1957 (Development and Regulation Act, 1957, `MMDR`) and the Mining Act, 1952, together with the rules and regulations contained therein, constitute the basic laws governing the mining sector in India. The Mining Concessions Rules 1960 set out the procedures and conditions for obtaining an exploration licence or mining concession. The Mineral Conservation and Development Rules of 1988 set out guidelines for ensuring science-based mining while protecting the environment. However, the provisions of the Regulation respecting mining concessions and the Regulation respecting the conservation and exploitation of minerals do not apply to coal, nuclear minerals and minerals of minor importance. Smaller minerals are reported separately and fall under the jurisdiction of state governments. To this end, the State Government has formulated the Madhya Pradesh Minor Minerals Rules 1996, the Madhya Pradesh Minerals (Prevention of Illegal Mining, Transport and Storage) Rules 2006, Madhya Pradesh Gramin Avsanrachna Tatha Sadak Vikas Adhiniyam, 2005, Madhya Pradesh Gramin Avsanrachna Tatha Sadak Vikas Niyam, 2005.
